1. Who is Vizigy?

Vizigy is a California Corporation - Vizigy, Inc., located in the heart of Silicon Valley in California, USA. Any personally identifiable information collected in connection with the Vizigy web sites is collected and maintained by Vizigy, Inc. 2. What is Personally Identifiable Information?

Personally Identifiable Information is that information that identifies a particular individual, such as a name, email address, street or postal address, or telephone number. When we collect other Information which we directly associate with personally identifiable information (for example: gender or musical preferences) we also treat that information as personally identifiable for purposes of this privacy policy so long as it is associated with the personally identifiable information. Your username (or screen name or other online alias) that you provide in the course of registering for any services or joining any online community is not personally identifiable information.

3. What Personally Identifiable Information does Vizigy collect?

Personally identifiable information collected by Vizigy can be grouped into the following categories:

A. Information that you submit to Vizigy websites

Most of the Personally Identifiable Information collected is entered by you when you interact with a Vizigy web site by, for example, joining a Vizigy on line community, registering with a Vizigy web site, signing up for a mailing list, or purchasing something from a Vizigy web site. Normally, this information includes, at a minimum, your email address, but can also include other things such as your name, your postal address, your phone number, your gender, and your musical interests. When you make a purchase from a Vizigy web site, we will collect additional information, for example, your credit card number, your billing address, the services or products ordered/purchased, the date of the order/purchase, the IP address associated with the order/purchase, and for products subject to digital rights management we will associate a personal key allowing you to access the purchased products with your personally identifiable information. When you post comments, photographs or videos to any Vizigy web site or to any message board, social networking feature, chat room, user profile, or any other public forum connected with any Vizigy web site ("User Postings") those postings may also contain personally identifiable information. Any User Postings may be publicly posted and otherwise disclosed without limitation as to its use by third parties. We may also collect personally identifiable information about you when you log on, register with, or visit a Vizigy web site and when you engage in activities on the web sites, such as entering contest, or sweepstakes, playing games, participating in promotional offers, or speaking with our customer service representatives.

B. Information that Vizigy websites collect through technical means

Vizigy web sites collect information about visits to the web sites in order to make the sites more interesting and useful to you as well as for a variety of business purposes. Most of this information, standing alone, is not personally identifiable information, but may be associated with personally identifiable information for some purposes. This information includes:

Log Information. When you visit or use the Vizigy web sites, we may automatically collect and store information about your visit in our Server Logs and eLearning Progress Logs. This information may include:

  • Internet Protocol Address (IP address);
  • Details of how you are using the web site, for example: search terms used, pages visited, eLearning course materials viewed and completed;
  • Information about your web browser and computer, for example: browser type, browser plugins, browser language, operating system, hardware settings, referral URL, and the date and time of your visit to the web site;
  • Cookies that identify your browser or your Vizigy account.

The IP Address is usually assigned by your Internet Service Provider (the phone or cable company, university, school, or business) when you log on to the Internet. By itself, the IP address usually does not personally identify you, although it usually does identify the business, school, university, phone company or cable company through whom you obtain your Internet connection. We may use IP addresses to collect information about the frequency of visits to various pages on our web sites, to enforce geographical restrictions of our licensors in the distribution of digital content, or to manage Digital Rights Management of digital content purchased/subscribed from our sites. We may combine IP addresses with Personally Identifiable Information.

We also use cookies and web beacons to enhance the user experience and to track visits to Vizigy web sites. Cookies are small pieces of information that our web sites send to your computer while you are visiting our web sites so that our web site knows how to properly display information to you. For example, when you log in to a web site, the web site sets a cookie that lets the web site know that you are logged in and therefore allows you to see content only available to you. Web beacons are small pieces of information embedded in images on web sites or in email messages.

We may also use web storage as implemented in the HTML5 specification to store information on your computer when the information is too large to be easily stored in a cookie, and when storing the information is intended to enhance your web site experience.

We may use the information collected through technical means on the web sites for a variety of different uses, including, but not limited to, enhancing the user experience, enabling the delivery of content, tracking your usage of our web sites and analyzing the traffic patterns on our web sites. When we send you HTML emails we may use the information collected for a number of purposes, including, but not limited to determining whether and when you open or forward those emails, to customize the display of content in those emails, to customize the display of banners, advertising or other messages on our web sites after you have viewed the emails.

Advertising appearing on our web sites may be placed and/or managed by third party advertising networks. Advertising networks may use cookies, web beacons and/or web storage to collect non-personally identifiable information about your visits to our web sites as well as other web sites. They do this to be able to provide you with advertisements of goods and services that might be of interest to you. When you click on a banner or link in a third party advertisement, our Privacy Policy does not apply to any information collected by the third party and you should ready the privacy policy posted on that third party's site to see how they will handle any personally identifiable information that they obtain about you.

C. Information that Vizigy collects from third parties

We may obtain information about visitors and potential visitors from third parties and use that information to supplement or update the information we have collected directly from our visitors. For example, if you are a student in a class and your instructor has set up an account on Vizigy for you to use, we collect information about you from your instructor in order to set up, activate and manage your account. When we acquire such personally identifiable information from third parties, we will treat that information the same way as other personally identifiable information collected directly from you through our web sites.

4. What choices an you make about Personally Identifiable Information collected by Vizigy?

There are three different opt-out choices available to you for information you provide under this Privacy Policy. By exercising your opt-out choices, you give us permission or decline to give us permission to use your personally identifiable information for the purposes connected with each of these opt-out choices. If you do not opt-out of a particular use, you give up permission to use your personally identifiable information for that use.

You can exercise your opt-out choices in one of four ways: a) during the registration process on the web sites you may select your opt-out choices; b) after registration on our web sites, you can log on and modify the opt-out choices in your user profile; c) after registration on our web sites, you can email us at privacy@vizigy.com and indicate the change you want to make in your opt-out choices; or d) with respect to opt-out regarding the Vizigy Newsletter, you may click an opt-out link on any Newsletter email and follow the opt-out instructions.

Your three opt-out choices are:

Newsletters: You may choose to opt out of receiving the Vizigy Newsletter. This opt-out choice is found in two places a) in a link contained in every Vizigy Newsletter; and b) in your user profile section of the web sites.

Promotional Offers from Vizigy: You may choose to opt out of receiving promotional offers from Vizigy. This opt-out choice is found in your user profile section of the web sites. A link to opt-out of receiving Promotional Offers from Vizigy may also be available in promotional offers you receive from Vizigy.

Promotional Offers from Third Parties: You may choose to opt out of receiving special promotional offers from third parties with whom Vizigy would otherwise share your personal information. This opt-out choice is found in your user profile section of the web sites. Emails containing promotional offers from third parties may also contain links allowing you to opt-out of receiving further promotional offer emails from those third parties.

Generally, your last selected opt-out choice will govern, should you make inconsistent opt-out selections. It can take up to ninety (90) days for your opt-out choices to be effective, due to the time it takes to update our systems, and the fact that promotional mailings using your personal information may be in progress at the time that you make a change to your opt-out preferences.

Keep in mind that if you change your email address or your postal address, or you do not use consistent email or postal addresses, we may not be able to match your request for changes in opt-out choices to the personal information you previously provided to us.

If you purchase or subscribe to products or services from Vizigy, we may accompany the delivery of such products or services with promotional materials for Vizigy or third parties even though you have opted out of receiving promotional offers covered by your other opt-out choices. Such promotional offers will constitute only a minor part of any such communication with you.

5. How is Personally Identifiable Information used and shared?

We may use your personally identifiable information for a number of different purposes related to operating our web sites, providing you materials that promote the web sites and the purchase of products and services available on our web sites, and sharing your information to select third parties so that they can provide you with materials promoting goods and services. You can opt-out of certain uses of your personally identifiable information - see below.

Web Site Operations. Uses of your personally identifiable information in web site operations includes, but is not limited to, using your information to complete a transaction such as registration, purchase of or subscription to goods or services, using your information to respond to inquiries made by you, using your information to send you administrative communications about the web site or your account, such as changes to terms of use or this Privacy Policy, or using your information to provide customer service requested by you. You may not opt out of this web site operation usage of your personally identifiable information.

Promotions and Newsletters. Unless you opt-out, we may use your personally identifiable information to communicate web site promotions, product promotions, service promotions and newsletters to you by way of email, postal mail, and other technological means. Please note that when you order products or services from us we may include promotional messages together with the products or services even if you have opted out of receiving promotions and/or newsletters in general.

Sharing with Content Licensors. We may share your personally identifiable information with companies from whom we license products or services available for purchase or subscription on our web sites. We may also share your personally identifiable information with companies that offer products or serviced co-branded with Vizigy. We will only share your personally identifiable information with such third parties who have contractually agreed not to use your information for any purpose other than promotion or marketing of the licensed or co-branded products or services, and is subject to your opt-out of receiving promotions.

Sharing with Sponsors of Certain Web Site Content. We may share your personally identifiable information with third parties that sponsor content appearing on our web sites, such as contests, sweepstakes, games, shows, or other programs, to the extent that you participate in that content and provide personally identifiable information related to your participation in that content. Such information will be collected in accordance with the particular sponsor's privacy practices and so your general opt-out choices will not apply to that information.

Sharing with Third Parties that Facilitate Transactions or Communications. To the extent we use the services of a third party to facilitate a transaction with you or to provide communications to you, we may provide those third parties with so much of your personally identifiable information as is necessary for them to facilitate the transaction or make the communication. Examples include credit card processing services, shipping services, fulfillment services, etc ... You may not opt-out of the sharing of your information for these purposes.

Sharing with Schools/Instructors. To the extent that you use the web sites to take classes, courses or subscriptions, we may share with the School and/or Instructors details of your subscriptions, payments, progress in viewing and completing the course materials, feedback and comments on the course materials We may provide those Schools and Instructors with so much of your personally identifiable information as is necessary for them to manage your instruction. You may not opt-out of the sharing of your information for these purposes.

Authorizations by You. To the extent that you have provided a third party with an authorization to obtain personally identifiable information about you from us, we will comply with your authorization and disclose that information to the third party. Your opt-out elections on our web sites would not apply since you have made an authorization outside of our web sites.

Non-Personally Identifiable Information. We may either remove personally identifiable information from your information or combine your information with that of others in a way that obscures any personally identifiable characteristics - aggregated information. This Privacy Policy does not restrict our use of such Non-Personally Identifiable information.

Information Transferred as part of a Sale or Purchase of a Business. Should personally identifiable information be transferred to us when we acquire all or a portion of another business, such information will, to the extent it is practicable and permissible to do so, be treated under this Privacy Policy as though the information was collected by us. Should we sell all or a portion of our business and should personally identifiable information be transferred to a third party in connection with such a sale, we will include in the contract of sale provisions requiring the acquiring company to comply with this Privacy Policy (including any amendments to the Policy) with respect to that information. Your opt-out choices do not affect our right to transfer your information to such a purchaser.

Information Disclosed to Comply With Laws and Protect Security. No matter what opt-out choices you make, Vizigy may disclose personal information when it believes, in good faith, that such disclosure would (1) facilitate compliance with laws (e.g. court orders, subpoenas, etc . . .); (2) help to enforce our Terms of Use; (3) help to enforce contest, sweepstakes, promotions, and/or game rules; (4) help to protect your safety or security or the safety or security of your property; (5) help to protect the safety or security of our web sites; (6) help to protect the safety or security of property belonging to Vizigy; or (7) help to protect the safety or security of property belonging to licensors of content, products or services available through our web sites, including, but not limited to copyrights and trademarks of such content providers.

Our web servers also collect information regarding the search terms utilized to find our web sites and the URL of the referring web sites.

If we do combine such information, we will treat all information as though it was received under the terms of this Privacy Policy, and will only be shared as provided in this Privacy Policy.

8. How can you access and update your information and opt-out choices?

You can access and update your personally identifiable information and your opt-out choices in one of three (3) ways: a) during the registration process on the web sites you may enter and edit your personally identifiable information and select your opt-out choices; b) after registration on our web sites, you can log on and modify your personally identifiable information and opt-out choices in your user profile; or c) after registration on our web sites, you can email us at privacypolicy@vizigy.com and indicate the change you want to make in your personally identifiable information and your opt-out choices. This third option is the only one available to you if your account has expired or has been terminated pursuant to our Terms of Use.

When you receive a promotional email, you may opt out of further such communications by clicking on an opt-out or unsubscribe link in the email and following the instructions.

9. What security measures are in place to protect Personally Identifiable Information?

The security and confidentiality of your personally identifiable information is very important to us. We have implemented technical, administrative, and physical security measures to protect your personally identifiable information from being improperly accessed or utilized. We review and reconsider our technological, administrative and physical security choices on an ongoing basis. However, even with our best efforts, no security is guaranteed to be impenetrable.

10. How will you know if we change this Privacy Policy?

We may amend this Privacy Policy from time to time at our discretion. If we do amend this Privacy Policy, we will post the amended Privacy Policy on our web sties. If the amendment constitutes a material change in the way we collect, use, and/or share your personally identifiable information, we will notify you of the change by sending you and email at the last email address you provided us and by posting a notice about the amended Privacy Policy on the web sites in a prominent manner. Any amendment to the Privacy Policy will not be effective for thirty (30) days following our sending the email notification to you or posting the notice of the change on our web sites. It is your responsibility to keep the email address connected with your registration on our web sites current. If our email notice to you does not reach you because the email address you provided was invalid or for any other reason, our mailing still constitutes an effective notice of the amendment of the Privacy Policy. If you do not wish to agree to the amendment, you will have to notify us in the manner we specify in the notice of the amendment before the effective date of the amendment. If you provide us such a notice, we may choose to deactivate your registration and account.
